Lights Out for Digital Billboard After Sleepless Couple Sues

It's lights out for a digital billboard near the home of a sleepless Pennsylvania couple who sued over the glare.

Commonwealth Court tossed a local ordinance that allowed digital billboards in Northampton County's Palmer Township to be lighted around the clock. Charles and Betsy Deifenderfer sued the township over the law, saying the billboard was keeping them up.

Pennlive.com
reports that township supervisors initially considered an ordinance that would have required companies that operate digital billboards to turn them off overnight. The supervisors removed the restriction after a billboard industry rep complained.

Commonwealth Court says the supervisors didn't give the public adequate notice to comment on the change, so the law is void.
