PHILADELPHIA -- A man who was brutally beaten on a Philadelphia subway concourse in September is preparing to sue the city and its main transit agency.
A lawyer for 23-year-old Eric Najee Derrickson says the Sept. 16 attack on him could have been prevented with better security. He notes that Derrickson was beaten on the same concourse where a man was fatally beaten in March.
A 25-year-old man is charged with attempted murder in the attack on Derrickson, which police say motivated by jealousy. The suspect's ex-girlfriend later gave birth to a child fathered by Derrickson.
Shortly after the beating, officials from the city and the Southeastern Pennsylvania Transportation Authority said the attack could have happened anywhere.
