Teen Goes to Trial for Tipping Porta Potty With 7-Year-Old Inside: Court

Teen allegedly forced a 7-year-old into a Porta-John and knocked it over, trapping him inside

A Delaware teen who allegedly forced a 7-year-old boy into a Porta-John and knocked it over, trapping the boy inside, will go to trial.

In a hearing Monday, a judge said that a trial date will be set for the 14-year-old who is charged with unlawful imprisonment, assault and harassment.

Seven-year-old Zach Montero was riding his bike with friends his age on Scottfield Drive in Newark, Del., Sunday Oct. 10 when the alleged bully threatened him into the portable toilet.

“He told me to get in it or he’ll break my pedals and bend my handle bars and pop my tire,” Zach said.

The 14-year-old pushed the Porta-John on to the door side, trapping Zach inside covered with the contents of the toilet.

“He had feces and urine all over him,” said Zach’s father David Montero.
