Toxicology Results β€˜Negative' in Death of Missing Boy, 3, in Quiet South Jersey Community: Lawyer

Weeks after a missing 3-year-old South Jersey boy turned up dead in some woods near the Cooper River, the lawyer for the boy's father is ruling out another possible death scenario that prosecutors have yet to confirm.

Philadelphia lawyer Richard Fuschino Jr. told NBC10's Cydney Long that toxicology on Brendan Creato's body came back negative.

The Camden County Prosecutors Office has yet to confirm the result, however, as the final autopsy on the boy who was found dead the morning of Oct. 13 near the bank of the Cooper River remained open.

Prosecutors earlier said that there was no indication of forced entry at Brendan Creato's father's home after the boy went missing. And there was no indication the boy was sexually assaulted.

The boy's body was found in Cooper River Park about a half-mile from his father DJ Creato's home in Haddon Township about three hours after the elder Creato called 911 to report his son missing.

Fuschino Jr. represents DJ Creato.

"I became engaged with this case on the day of the boys disappearance, DJ's friend advised him, and I agree it's a smart move when you have something like this because it's a complicated process," Fuschino Jr. told NBC10.

The attorney said his client spoke to investigators prior to obtaining his counsel.

"I have every confidence that police are doing everything they can...to get to the bottom of this," said Fuschino Jr.
