The state Commonwealth Court says a lower court must determine whether a Harley-Davidson plant in eastern Pennsylvania is owed a refund on its local property taxes.
The York Dispatch reports York County Common Pleas Court must determine whether Milwaukee-based Harley Davidson Inc. is owed nearly a $2 million refund from the county, the Central York School District and Springettsbury Township.
That's where Harley-Davidson has operated a plant since 1973.
The plant site once housed the York Naval Ordnance plant and later American Machine and Foundry Co., which made bomb casings before merging with Harley-Davidson and manufacturing motorcycles there.
Harley-Davidson contends environmental cleanup problems at the site should reduce its taxable value. The cycle-maker has been suing since it appealed a ruling in 2004 increasing the plant's taxable value from $10 million to $39 million.
