A defense attorney said an eastern Pennsylvania police chief's son accused of pointing a gun at county detectives will take to the stand during his trial.
Attorney Jack McMahon said Wednesday that 23-year-old Christopher Fitzgerald is a "man of character'' and will take the stand.
Fitzgerald, the son of Allentown Police Chief Joel Fitzgerald, faces simple assault and reckless endangerment charges. Prosecutors said he pulled a gun on undercover detectives following an August road-rage incident.
McMahon said Fitzgerald showed the gun to the detectives because he feared for his girlfriend and 1-year-old son in the car. He says the actions weren't criminal.
First Assistant District Attorney Steven Luska said Fitzgerald misjudged the situation, but committed a crime by threatening them.
Fitzgerald had a permit to carry the weapon.
