Rehoboth Restaurant Wins Patio Dispute

Delaware's Supreme Court has ruled that a Latin-Asian fusion restaurant in Rehoboth Beach can add a patio without risking its grandfathered status as a larger-than-permitted restaurant.
 
The News Journal reports that the ruling may end a three-year legal dispute between the restaurant, Stingray, and Rehoboth Beach officials. The Dec. 9 opinion affirms a February decision by Superior Court Judge E. Scott Bradley.

Stingray argued that the project shouldn't jeopardize its grandfathered status and sued after its variance request was denied. Bradley ruled the city incorrectly saw the patio as an extension of the restaurant structure.
