Woman Charged in Boyfriend's Death Says He Robbed Her

Prosecutors are asking a northeastern Pennsylvania judge to allow them to present evidence that a woman charged in the shooting death of her live-in boyfriend once staged a purported burglary at her residence.

Thirty-year-old Jessica Alinsky is charged in the September 2011 shooting death of 34-year-old Matthew Gailie at their Hazle Township home. She has maintained that he shot himself in the face during a dispute.

The (Wilkes-Barre) Citizens' Voice reports that Luzerne County prosecutors argue that Alinsky staged the scene to make it look like suicide, and they argue that they should be able to offer evidence of a fabricated burglary six months earlier. Alinsky pleaded guilty to third-degree murder in April but withdrew the plea in May. Prosecutors are now seeking a first-degree murder conviction.
