Teen Murder Suspect β€œToo Cold”

A northeastern Pennsylvania teenager who says he was too cold to think clearly when he was interrogated by state police is asking a judge to dismiss the interviews from his trial in the shooting death of his elderly great-grandfather last year.

Cody Lee, who turns 17 on Monday, says he had been wandering through the woods for hours before he was arrested Dec. 10 and waived his rights in the death of 80-year-old Herbert Lee Sr.

Defense attorneys want the police interviews barred from Lee's trial, and Luzerne County prosecutors will be allowed to present arguments against that at a hearing Friday. The defense also wants the case moved to juvenile court.

Prosecutors say Lee showed classmates at Lake-Lehman High School a notebook outlining plans to "kill grandpa'' and then, once his father got home, "kill dad.''
