UPDATE: Delaware County District Attorney John Whelan announced on Oct. 20 that a simple assault charge would be dropped in this case. "We believe there is insufficient evidence to proceed with the prosecution of this case," said Whelan in a news release.
A lawyer for the headmaster of a prep school in Philadelphia's affluent Main Line suburb says he wants an assault charge dropped that was lodged against his client after police say the man assaulted his son in a dispute over a cellphone and marijuana.
The Haverford School placed John Nagl on administrative leave after police charged Nagl on Monday.
Nagl told police he took his son's cellphone and marijuana, and a physical altercation ensued when he heard his son talking on the phone. Police say Nagl admitted putting his son in a choke hold.
Nagl's attorney tells The Philadelphia Inquirer parents can use force to protect the welfare of a child.
The Delaware County District Attorney's Office says the matter remains under review.
