Judge Dismisses Hazing Lawsuit Claims Against Penn State Fraternity

A county judge is dismissing a former Penn State student's claims against the university over allegations of hazing and sharply narrowing his lawsuit against a fraternity.

The Legal Intelligencer reported Friday the judge left in place a negligence claim against the Kappa Delta Rho fraternity and gave James Vivenzio 30 days to rework fraud allegations.

A spokeswoman says Penn State is pleased with the decision.

Vivenzio said he exposed a secret Facebook page by the fraternity that featured photos of naked women.

His lawsuit claimed that as a freshman pledge he was burned with cigarettes and force-fed liquor mixed with urine, vomit and hot sauce.

The school's said it offered "extraordinary assistance" to Vivenzio, including sending an investigator to his home. Penn State suspended the fraternity for three years.
