Mental Infirmity Defense Planned in Wife's Murder

The attorney representing a northeastern Pennsylvania man charged in the shooting death of his wife says his client will be presenting a mental infirmity defense.

Prosecutors allege that 48-year-old Vito Aiello killed 47-year-old Jane Aiello in their Wilkes-Barre home in September before turning the gun on himself in a failed suicide attempt.

Defense attorney Demetrius Fannick said in a motion filed Monday in Luzerne County Court that "the nature, extent and duration" of his client's infirmity "is not known at this time."
 
The couple's teenage son said he was playing video games when he heard his parents arguing followed by a gunshot, then saw his father standing over his mother holding a pistol.
 
Court records indicate that shortly before the shooting, Jane Aiello had filed for divorce after 22 years.
