New Jersey Judge Denies Gag Order in Case of Mom Accused of Killing 5-Year-Old Son

A judge has denied a gag order sought by prosecutors against the lawyer of a mother charged in the 1991 slaying of her 5-year-old son in New Jersey.

The judge on Thursday denied the motion in the case of Michelle Lodzinski, who has pleaded not guilty to killing Timothy Wiltsey in 1991.

The Middlesex County Prosecutor's Office had sought a gag order against attorney Gerald Krovatin for statements he gave to The Associated Press about the case for an article published earlier this month. They said Krovatin's statements could have tainted the jury.

Krovatin said a gag order would have violated his First Amendment rights.

Lodzinski has maintained that Wiltsey disappeared from a Sayreville carnival. His remains were found about a year later at an Edison industrial complex where Lodzinski once worked.
