Defense Lawyer Testifies Against Fumo

A veteran defense lawyer testifying against his former client says he never told the ex-Pennsylvania lawmaker he could destroy evidence during an FBI probe.

Philadelphia lawyer Richard Sprague is on the stand in the corruption trial of Democratic power broker Vince Fumo. The two men were once close friends.

Sprague's rebuttal testimony comes after Fumo wrapped up six days of testimony. Fumo says he relied on advice from Sprague and others in 2004 when he told staff to destroy his e-mails.

Fumo knew the FBI was investigating a charity he founded. But he says lawyers said he could destroy e-mails because he had not yet been subpoenaed.

Sprague says he would never give that advice because evidence must be preserved once someone learns of an investigation.
