New Jersey Woman Refuses to Work Midnight Shift, Claims Discrimination

New Jersey's Supreme Court will hear a lawsuit by a former police dispatcher who claims she was discriminated against because she refused to work the midnight shift.

Patricia Del Vecchio worked for the Bridgewater Township police department until 2009, when she was fired for excessive absences. She had filed the lawsuit 10 months earlier.

Del Vecchio claims she was given the choice of transferring from her dispatcher job or being fired because she refused to work the midnight shift. She says she'd given her supervisors a doctor's note saying she had health issues and should avoid working the midnight shift.

A jury rejected her claims, but in August an appeals court ruled the judge unfairly restricted testimony about her condition.

The Supreme Court hasn't set a date for oral arguments.
