Jury mulls man's fate in waitress slaying

A jury must now decide the fate of a man charged with having raped and strangled a Philadelphia waitress almost two years ago.

Jurors heard closing arguments Tuesday in the case of 20-year-old Donte Johnson, who is charged in the June 2010 death of 20-year-old Sabina Rose O'Donnell in the city's Northern Liberties neighborhood.

Prosecutors are seeking a first-degree murder conviction. They cited DNA evidence and said Johnson told police that he killed the victim after she screamed when he tried to steal her bike. Her nude body was found in a vacant lot the next day.

Defense attorney Gary Server challenged the accuracy of the DNA evidence and said his client could not have made the statement because he functions at the intellectual level of an 11-year-old.

The jury will continue deliberations Wednesday morning at 9.
