Two Delaware County men were arrested after police say they were found in a vacant home with two naked underage girls.

On Saturday, around 12:30 a.m., a Glenolden Police officer responded to a possible burglary at a home on Dalmas Avenue, according to an affidavit of probable cause.  A 911 caller told police she saw a man walking around inside the home which was currently for sale.

The responding officer found an unoccupied tan Chrysler Sebring with a Pennsylvania license plate and the rear window smashed out, according to the affidavit. Police say the vehicle was registered to James Daw, 21, of Eddystone, Pennsylvania.

The officer walked inside the home and discovered there was no furniture inside though some of the inside lights were on, according to the affidavit. As he checked the doors, the affidavit states he saw a man, later identified as Daw, walking around with no shirt and pair of sweatpants. When the officer spoke with him, the affidavit states Daw claimed the home had been vacant for over 5 months but he had permission to be there. Despite this claim, the affidavit states Daw could not provide any physical proof he had permission.

While speaking with Daw, the officer suddenly heard another voice inside the house, according to the affidavit. The affidavit states the officer then found a naked 15-year-old girl in the basement bathroom. The officer walked upstairs to the 2nd floor where he found a naked man, later identified as Sean Ferguson, 22, in bed with another naked teen girl who was later discovered to be 15-years-old, according to the affidavit.

Both teen girls told the officer Daw picked them up in his vehicle at a McDonald’s in Essington the day before and drove them to the vacant home.  The girls also claimed both Daw and Ferguson gave them alcoholic beverages. The girls told police they had only known Daw and Ferguson for a short period of time but had been in contact with them via Facebook and texting. The girls were then taken to Taylor Hospital for further medical evaluation, according to the affidavit.

The affidavit states Daw provided a written statement admitting he and Ferguson picked the girls up, drove them to the home and provided them alcohol. Daw also allegedly admitted to having sexual relations with one of the 15-year-old girls in the past but not that night because “the cops came just in time.” Ferguson refused to speak with police, according to the affidavit.

Both Daw and Ferguson were charged with statutory sexual assault, indecent assault, indecent exposure, corruption of minors and other related offenses. The Delaware County Times reports neither were able to post 10 percent of $100,000 bail and were remanded to the county prison. They are both scheduled for preliminary hearings on August 29.
