Man Admits Failing to Deliver Sandy Victims' Promised Generators

A southern New Jersey man has admitted that he failed to deliver generators to two customers who had given him thousands of dollars in deposits following Superstorm Sandy.

Monmouth County prosecutors say 56-year-old Brian Nogiewich, of Toms River, has pleaded guilty to two counts of theft by deception and one count of failing to register with the state's Division of Consumer Affairs.

He now faces up to four years in state prison and will have to pay more than $7,000 in restitution.

Prosecutors say Nogiewich took nearly $3,000 from one resident and more than $4,700 from another for natural gas-powered electrical generators. But he never delivered the generators and didn't refund their payments.

Nogiewich entered his pleas Friday. A sentencing date has not been scheduled.
