Pennsylvania Superior Court has expedited former FBI director Louis Freeh's appeal of a lower court decision to delay a defamation suit brought by former Penn State president Graham Spanier.
The Centre Daily Times reports the Superior Court has scheduled arguments on the appeal for May 20 in Philadelphia.
Spanier faces criminal charges for an alleged criminal cover up of complaints about retired assistant football coach Jerry Sandusky.
Freeh produced a report for Penn State that criticized how Spanier and other administrators handled the Sandusky scandal, prompting Spanier to file a court notice that he planned to sue Freeh for defamation.
Spanier has sought to delay filing that lawsuit, arguing that his testimony in the civil lawsuit could harm his criminal defense.
Freeh wants to overturn a Centre County judge's decision allowing Spanier to delay his lawsuit.
