Former Pa. Officer's Assault Conviction Upheld

An appeals court has rejected the appeal of a former central Pennsylvania police officer convicted of assaulting two men and then trying to cover up his involvement.

The (Altoona) Mirror reports that the Pennsylvania Superior Court upheld the aggravated assault and records tampering convictions of 31-year-old Duane Eichenlaub of Altoona. The former Altoona police officer was sentenced to 11-1/2 to 23 months in jail.

Prosecutors said he and another officer beat up a man over an incident involving Eichenlaub's wife following a wedding reception several years ago. Another man who tried to break up the fight was also hurt.

The appeals court rejected defense arguments that Eichenlaub was just following his police and Army training and that the injuries weren't severe enough for an aggravated assault conviction.
