Feds Seek Dismissal of Counts Against Pa. Attorney

Federal prosecutors are asking a judge to dismiss all federal charges against a northeastern Pennsylvania attorney accused of having stolen millions of dollars from clients.

U.S. Attorney Peter Smith filed a motion in U.S. District Court in Scranton on Monday to dismiss a superseding indictment against 80-year-old Anthony Lupas.

A federal judge ruled last fall that Lupas was not competent to stand trial. Smith said his condition has deteriorated and isn't expected to improve, and he cannot assist in his defense.

He asked that charges be dismissed without prejudice, meaning they could be refiled if his condition were to improve.

Authorities have alleged that Lupas bilked clients of more than $6 million over 18 years, promising returns of at least 5 percent in what officials describe as a Ponzi scheme.
