DUI Case Back on for Pa. State Rep

Police say Pennsylvania state Rep. Cherelle Parker drove the wrong way on a one-way street with a blood-alcohol level of 0.16.

The drunk-driving case against a Pennsylvania state representative is on again after initially being undercut by a judge who lists the lawmaker as a Facebook friend.

A Common Pleas Court judge said Tuesday the case against state Rep. Cherelle Parker should go forward because the judge who suppressed evidence in the case should have recused himself.

Police say the Philadelphia Democrat had a blood-alcohol level of 0.16 when she was pulled over April 30 after going the wrong way down a one-way street. The legal limit for drivers is 0.08.

But Municipal Court Judge Charles Hayden ruled the officers' testimony wasn't credible at a hearing in November.

The Philadelphia Inquirer reports Parker didn't speak following Tuesday's hearing. Defense attorney Jack Kelly says he'll appeal to the state Superior Court.
