Recount likely in tight Commonwealth Court race

A ballot recount appears likely in a close race for the Democratic nomination for Pennsylvania's Commonwealth Court.

Although a small number of votes remained uncounted Thursday, the Department of State running count showed the gap between Doylestown lawyer Kathryn Boockvar, the front-runner, and Pittsburgh lawyer Barbara Behrend Ernsberger, narrowing to well within the margin needed to trigger the state's automatic recount law.

Ernsberger says she doesn't intend to waive her right to a recount because Pennsylvania Democrats are entitled to a clear answer about who won the nomination.

In 2009, Ernsberger was nominated for Commonwealth Court but lost in the general election.

If the recount is triggered and the trailing candidate doesn't withdraw by Thursday afternoon, state officials say the recount process will be set in motion.
