Pennsylvania Schools Sue Gov. Tom Wolf, Lawmakers Over Budget Impasse

The Pennsylvania School Boards Association is suing Gov. Tom Wolf and the state Legislature, saying it's illegal and unconstitutional to withhold state and federal school aid during a budget impasse.

The lawsuit, filed Friday, asks Commonwealth Court to prevent the state from withholding the dollars.

The lawsuit also seeks damages for the loss of investment income and borrowing costs while schools went six months without aid.

Wolf authorized about $7 billion last week after a budget stalemate with the Republican-controlled Legislature going back to July 1. That's about six months of retroactive school funding, and raises the possibility that schools could see another funding crunch in the coming weeks.

Some school districts had warned that they'd remain closed after winter break and some worried they'd be unable to borrow more money to make payroll in January.
