A homeless man is accused of raping an unconscious woman who was lying on the Ben Franklin Parkway early Wednesday morning.
Philadelphia Police say Warren Fitts, 48, was seen having intercourse with the 28-year-old woman at 2:50 a.m. on the 1500 block of the Parkway.
The woman was taken to Hahnemann Hospital in stable condition.
Philadelphia Police Commissioner Charles Ramsey told NBC10 the woman was heavily intoxicated.
"Someone actually saw him having sex with the woman. The woman was obviously incapacitated and police arrived and we were able to grab him," said Ramsey.
Ramsey says it's not clear where the woman was prior to the attack or where she was headed to.
"She obviously had been drinking, she also had prescription pills in her purse, it could have been a combination," said Ramsey.

Fitts is charged with rape, unlawful restraint, false imprisonment, sexual assault, simple assault and related offenses.
According to court records, Fitts has been arrested more than 20 times for crimes ranging from robbery to disorderly conduct.
Investigators are now working to find out if Fitts is connected to other sexual assaults in the area.
"We're looking at similar crimes, we also took a DNA swab from him to see if it matches any of our unsolved cases," said Ramsey.
