An appeals court has upheld the convictions of a Jersey City man implicated in the shooting of a Willingboro police officer during a 2004 burglary, but ordered the defendant re-sentenced.
NJ.com reports Kelvin Rosa was convicted of attempted murder and burglary in the shooting of Officer Richard Rogers, who survived but was forced to retire due to his injuries.
Rosa was initially given consecutive sentences of 20 years for the attempted murder charge and 10 years for the burglary. The appellate court's ruling Monday found the judge relied too much on crimes Rosa was suspected of but never convicted in his sentencing.
Burlington County Prosecutor Robert Bernardi says his office is confident they will convince the court that the original sentencing should be imposed on Rosa once again.
