Whole Foods, Acme, Wegmans Sued Over Baked Goods

Consumers in New Jersey are suing three supermarket chains, claiming their bakery good are not really made from scratch in the stores.

The suits filed in state court in Camden on Tuesday assert that Acme, Wegmans and Whole Foods Market all prepare baked goods elsewhere and just reheat them in their stores.

According to The Courier-Post of Cherry Hill, the suits say the chains are making fraudulent claims to consumers. The complaint against Acme states, "It was defendant's intent to mislead consumers they are buying bread and bakery products that were 'made in house' from scratch," according to the paper.

Representatives from the three grocery companies told The Courier-Post they have not seen the lawsuits or won't comment specifically on litigation.

A spokeswoman for Acme said they are not deceiving customers.

Wegmans spokeswoman Jo Natale also denied deceiving customers.

"We’ve received no notice of any such lawsuit," said Natale. "And we haven’t deceived our customers in any way."

Whole Foods spokeswoman Katie Malloy said the company doesn't comment on pending litigation.

The lawyers behind the suits are seeking class-action status and want damages of at least $100 per customers who buy products labeled "fresh baked" each week.
