TD Hit With Another Class-Action Lawsuit Over Coin-Counting Machines

Another class action lawsuit has been filed against TD Bank, which took its Penny Arcade coin-counting machines out of service earlier this month after an investigation found they have been shortchanging customers.

The latest case, filed Wednesday in federal court in Camden on behalf of Regina C. Filannino-Restifo, described as a customer of TD’s Jefferson Valley, N.Y., branch and a frequent user of the bank’s Penny Arcade coin-counting machines because she owned a number of coin-operated washing and drying machines.

Her lawyers, Stephen P. DeNittis of DeNittis Osefchen in Marlton, N.J., and Jeffrey Smith of Wolf Haldenstein Adler Freeman & Herz in Manhattan, claim in the lawsuit that Filannino-Restifo “as a result of the deceptive conduct, suffered injury in fact and lost money” and that the Penny Arcade machines “have continuously undercounted coins placed in them by consumers for years and resulted in the loss of millions of dollars for consumers.”

The suit estimates a total loss of more than $5 million for customers of TD, the Philadelphia region’s second-largest deposit taker and one of the nation’s largest bank with nearly 1,300 branches between Maine and Florida.
