A man whose first-degree murder conviction was overturned is once again on trial in the shooting death of a central Pennsylvania woman almost a decade ago.
Thirty-three-year-old Ian Brenner has been imprisoned since 46-year-old Anna Marie Witter was killed and two men were wounded in October 2005 in York.
Brenner won a new trial in May 2013 after a state Superior Court agreed with his arguments that character witnesses should have been called on his behalf during his trial.
Authorities alleged that Brenner was trying to shoot a rival gang member when Witter was killed by a stray bullet as she sat on a stoop talking with a friend.
His attorney said he rejected an offer to plead guilty to third-degree murder in exchange for a 25- to 50-year sentence.
