A New Jersey man is suing a Delaware company for failing to deliver the "hypoallergenic kitten" that he ordered for $7,900.

Andrew Reale says he signed a contract for the kitten with Allerca, which also is known as Lifestyle Pets, in 2007, according to My Central Jersey.

Reale never got his cat, which was supposed to be delivered by Sept. 16, 2008, according to the lawsuit.

The suit says Allerca sent Reale an e-mail saying delivery had been affected by "decreased kitten production."

Reale wants his money back.

The biotech company's Web site  claims its cats are bred to produce a genetically engineered protein that will not cause allergic reactions in humans.
