Nemours Foundation Sues United Healthcare of Delaware

The foundation that owns the Alfred I. du Pont Hospital for Children in Wilmington is suing United Healthcare of Delaware for terminating a pediatric care contract that covered children covered by Medicaid and other state-subsidized health care programs.

The federal lawsuit filed in Wilmington on Monday by the Nemours Foundation seeks more than $15 million in damages from United Healthcare for breach of contract and unjust enrichment.

More than 33,000 children had been served by United under Medicaid and the Children's Health Insurance Program, but United terminated its agreement with Nemours last year.

Nemours claims it has not been paid in full for medical services and that United is forcing members to drive long distances for medical care.

A United Healthcare spokeswoman did not immediately respond to an email message.
