A second defendant convicted in the shooting death of a man found in a sport utility vehicle at the bottom of a Pennsylvania ravine is seeking a new trial.
Twenty-seven-year-old Jason Dominick was convicted in Lackawanna County of third-degree murder and conspiracy and sentenced to 40 to 80 years in prison in the July 2013 death of 24-year-old Frank Bonacci.
The (Scranton) Times-Tribune reports that Dominick argues that new evidence indicates that the fatal shot wasn't fired from the back seat, where he was sitting.
Co-defendant Neil Pal has also appealed his first-degree murder conviction and life term. Prosecutors said Pal drove Bonacci to an isolated area and provided the gun used by Dominick, and they then launched the SUV down a 72-foot ravine in northeastern Pennsylvania.
