Man Charged With Rape and Murder of Church Worker Moved to Delaware, A Death Penalty State

A man charged in the rape and murder of a church worker whose body was found in Maryland has been extradited to Delaware.

Thirty-one-year-old Matthew Burton of Dagsboro, Delaware, is charged in the killing of 35-year-old Nicole Bennett in June 2012.

Bennett was found dead in Maryland's Worcester County; she was last seen at her job at a church in Gumboro, Delaware. Burton, a custodian at the church, was arrested in July 2012 near Rehoboth Beach, Delaware.

Burton was brought to Maryland before an investigation found that the killing likely was committed in Delaware.

Burton arrived in Delaware on Wednesday after the Maryland Court of Appeals denied a petition to hear his case. Burton argued that prosecutors only wanted him brought to Delaware because it's a death penalty state.
