A panel of Pennsylvania judges is considering whether to grant a request by the NCAA and throw out a lawsuit filed by a state senator and the state treasurer over the fine imposed on Penn State for its handling of the Jerry Sandusky scandal.
The Commonwealth Court judges indicated after courtroom arguments Wednesday it will be at least two days before they will decide whether to allow the case to proceed.
Sen. Jake Corman, who represents the State College area, and Treasurer Rob McCord want the court to declare that the $60 million from Penn State must be paid into the state treasury.
Penn State agreed to the monetary penalty last year, and has set aside the first $12 million.
Sandusky was convicted of child molestation and is in prison.
