A federal judge has ruled that jurors should decide whether an eastern Pennsylvania school district was responsible for a student's death after swimming in gym class 3 years ago.
The suit was filed against Bethlehem Area School District and several staff members following the death of 15-year-old Juanya Spady. The Liberty High School 10th grader who collapsed in another class after swimming in December 2010.
The lawsuit contends that the boy died of delayed drowning stemming from chemical-related toxicity from swimming pool chlorine. It says staff members should have been trained to respond to the danger.
A defense specialist contends that the boy died of congestive heart failure. An autopsy concluded that he died of a seizure of undetermined origin.
Judge Joel Slomsky Jr. said jurors should resolve the disagreement.
