Home Nurse Acquitted in Baby Death

An in-home nurse has been acquitted of child endangerment in the death of a premature southwestern Pennsylvania baby who died of respiratory distress while she was caring for him three years ago.

Jurors in Fayette County deliberated for about an hour and a half Friday before acquitting 44-year-old Jackie Yeagley of North Union.

Seven-month-old Derek Miskanin Jr. died about an hour after he began having trouble breathing at home in December 2011.

Yeagley testified that she did everything she could for the boy. The child's parents indicated that she hadn't followed protocols established by his doctor.

Assistant District Attorney Gene Grimm said he was "totally dismayed" by the verdict. Defense attorney Christopher Capozzi said his client was "pleased the process worked the way the process is supposed to work."
