Wilmington to review street performance ordinance

Wilmington officials say a man who wants to play his guitar on a city sidewalk can do so, at least for now.

Officials have told the American Civil Liberties Union that pending a review of the city code, they're granting a temporary itinerant performer permit to John Crowley.

Crowley contacted the ACLU after being approached by police recently while playing his guitar in the Trolley Square area, told he needed a permit and threatened with arrest.

The ACLU subsequently learned that the city's ordinance on street performances appears to be unconstitutional because, among other things, it allows officials to review performances for โ€œappropriate contentโ€ before issuing a permit.

City officials say they will work with the ACLU in reviewing the ordinance for any changes that need to be made.
