Penn State fraternity found guilty of furnishing alcohol to a freshman who died

A Penn State fraternity has been found guilty of furnishing alcohol to a freshman who died after falling into a stairwell after a night of drinking last year.

Centre County Judge Thomas King Kistler on Tuesday said Alpha Tau Omega was responsible for supplying alcohol to 18-year-old Joe Dado hours before he died in September 2009.

Prosecutors say the beer was purchased with fraternity funds and friends of Dado testified they flashed wristbands at the frat's door to get in.

The judge found the fraternity had furnished the beer to minors by providing open tubs that welcomed guests to consume the beverages but didn't check IDs.

The fraternity had argued individual members were at fault, not the organization.

Alpha Tau Omega likely faces fines and community service at its January 25 sentencing.
