Pennyslvania Deputy Justified in Killing Escapee Who Shot Him First: DA

Prosecutors say a Pennsylvania sheriff's deputy was justified in shooting and killing a prison escapee who fired at him first, hitting him in the face.

The York County District Attorney's Office said in a report Wednesday that deputy Michael Lutz's actions on the morning of June 9 were in response to the deadly conduct of 38-year-old James Nickol.

Authorities say Lutz and other deputies tracked Nickol to his girlfriend's home in York after he walked away from a prison work release facility. Deputies found the man and investigators say he opened fire as Lutz approached. Lutz was shot in the face and thumb, but returned fire, hitting Nickol seven times.

Authorities say Lutz was treated and released from a hospital following the shooting, but hasn't returned to duty.
