Federal Judge Rejects Appeal in Delaware Double Murder Case

A federal judge has rejected an appeal from a Delaware man who pleaded guilty to murder in the middle of his 2003 trial, avoiding a possible death penalty.

According to court records, Miles Brice and a co-defendant in 2001 chased a man to his girlfriend's apartment. As they tried to force their way in, Brice fired 11 shots through the door, killing the man's girlfriend, 24-year-old Nicole Custis, and 16-year-old Brandon Durant.

After several unsuccessful appeals at the state level, Brice, serving two life terms, filed a federal writ of habeas corpus in 2014.

The judge rejected the appeal Thursday because it was made more than nine years after the one-year window had expired.
